Each of the terms mentioned below will have, in these Terms of Use, the following meaning:
Advertisement: means all the elements and data (visual, textual, sound, photographs, drawings), deposited by an Advertiser under its editorial responsibility, in order to buy, rent or sell a property or to offer a
service and posted on the Website and Applications.
Advertiser: refers to any major physical person or legal person who has submitted and posted an advertisement via the website www.luxurypulse.com.
Personal Account: means the space, accessible from the Website and Applications, which any Advertiser
must have, and from which he can broadcast, manage, view his ads.
Website: means the website accessible mainly from the URL www.luxurypulse.com and allowing Users
and Advertisers to access the website www.luxurypulse.com via the Internet.
User: means any visitor having access to www.luxurypulse.com via the Internet.
These General Conditions of Sale establish the contractual conditions applicable to any subscription, by an Advertiser connected to his Personal Account from the Website.
Any subscription by an Advertiser implies full and complete acceptance of the current General Conditions of Sale.
4.1 General rules
The subscription proposed by Luxury Pulse allows the posting of advertisements.
This subscription offers rights for a fixed term.
The duration of these rights is determined in the contract between the Advertiser and Luxury Pulse.
A subscription therefore has a start date and an end date.
The subscription price may vary depending on the category of ads.
Ads are classified (by default) on the Website in chronological order, according to the date and time of
their posting. As a result, any Advertiser acknowledges and agrees that the presence at the top of the list
of its Announcement is provisional.
Luxury Pulse nevertheless reserves the right to select the ads of its choice to position them at the top of
the list.
4.2 Duration of subscription and announcements
All ads placed by the Advertiser on his personal space have a limited duration that depends on the duration of the subscription of the Advertiser.
Ads do not have an individual duration.
All ads associated with a subscription expire at the same time as the validity date of the subscription is
exceeded.
The deletion of a Personal Account generally results in the suspension of any Ad (s) attached to this account and gives no right to indemnity or compensation, which the Advertiser acknowledges and accepts.
4.3 Renewal of a subscription
The subscription is renewable by tacit agreement.
4.4 Termination of a subscription
The Advertiser may terminate his subscription at any time by sending a registered letter with acknowledgment of receipt.
This termination will have the effect :
• the suspension of the personal account
• suspending ads associated with the account
• the cancellation of the tacit renewal of the subscription
Nevertheless, this termination does not give any right to reimbursement or compensation for the payments already made, which the Advertiser acknowledges and accepts.
Any subscription will result in an invoice sent to the email address indicated by the Advertiser.
5.1 Refund
Paid subscriptions are non-refundable.
The cancellation by the Advertiser of a valid Personal Account does not give right to any refund or compensation, which the Advertiser acknowledges and accepts.
The deletion of a Personal Account by Luxury Pulse for non-compliance by the Advertiser of the rules of
use does not give right to any refund or compensation, which the Advertiser acknowledges and accepts.
5.2 Retractation
By validating the order, the Advertiser agrees that Luxury Pulse starts to perform the service and therefore expressly waives its right of retractation.
Luxury Pulse can not be held liable in case of non-performance or improper execution of the order due, either because of the Advertiser, or a case of force majeure.
The General Conditions of Sale are applicable from December 08, 2017. Luxury Pulse reserves the right, at any time, to modify in whole or in part the General Conditions of Sale. Advertisers are invited to regularly consult the General Terms and Conditions of Sale to learn about the changes made.
If any part of the General Terms and Conditions of Sale should prove to be illegal, invalid or unenforceable, for any reason whatsoever, the provisions in question would be deemed unwritten, without however canceling the other dispositions that will continue to apply between the Advertisers and Luxury Pulse. The General Conditions of Sale are subject to French law.
